Welcome to www.nutrisante.ca (hereinafter the “site”). This website is owned by IRB Yves Ponroy Canada Inc. (hereinafter referred to as “Nutrisanté Laboratories”). This website is provided for your personal use and information.
The purpose of this policy is to protect personal information and to define how Nutrisanté Laboratories collects, uses, communicates, retains and deletes or otherwise manages such information. It also aims to inform any person concerned about his or her rights and about the organization's data protection practices. It also applies to the processing of personal information obtained by technological means.
2. Application and definitions
This policy applies to Nutrisanté Laboratories and all persons acting on its behalf, such as its officers, employees, consultants, volunteers or other service providers. It also applies to all visitors and users of the Nutrisanté Laboratories website.
It applies to all categories of personal data processed by Nutrisanté Laboratories, whether it concerns data relating to current or potential customers, consultants, employees, members or any other person (such as visitors to its websites or others).

By providing this information, the site user expressly agrees to its processing by Nutrisanté Laboratories for the purposes set out below.

Retention and use:
Nutrisanté Laboratories ensures the relevance and accuracy of the information it holds when using it to make a decision concerning the person involved.

4. Retention and destruction of personal information
Nutrisanté Laboratories undertakes to respect the retention period for your personal information that it has established for each purpose for which it was collected, in accordance with the law or whether a specific request as to how long confidential information should be kept has been made. If the processing of your personal information is no longer justified by a legitimate business interest, we will erase or anonymize it or, if this is not feasible (for example, if your personal information is archived in backups), then Nutrisanté Laboratories will ensure the security of your personal information and prevent it from being used until it can be deleted.
5. Your rights
To exercise your rights of access, rectification or withdrawal of consent, you must send a written request to Nutrisanté Laboratories’ Privacy Officer at the email address mentioned in the last section of this policy.
By law, individuals may ask Nutrisanté Laboratories for access to and correction of their personal information if it is inaccurate, incomplete or ambiguous. They may also request that any of their personal information held by Nutrisanté Laboratories be deleted.
Nutrisanté Laboratories’ Privacy Officer must respond to such requests in writing within 30 days of receipt. Any refusal must be explained and supported by the applicable legal provision. In such cases, the reply must mention the legal remedies available and the time limit for exercising them. The person in charge must address the applicant to explain the refusal, if necessary.
Subject to applicable legal and contractual restrictions, the persons concerned may withdraw their consent to the communication or use of the information collected.
Nutrisanté Laboratories also permits individuals to know what personal information it holds on them, how long it is kept and to have a copy of it.
6. Complaint handling
Any person wishing to make a complaint concerning the application of this policy or, more generally, the protection of his or her personal information by Nutrisanté Laboratories, must do so in writing to the Privacy Officer at the email address indicated in the last section of this policy.
Nutrisanté Laboratories asks the complainant to provide his or her name, contact information, including a telephone number, as well as the subject and reasons for the complaint, in sufficient detail to allow the complaint to be examined. Nutrisanté Laboratories undertakes to respect the confidentiality of all complaints received and to respond to them within 30 days.
7. Data storage
Personal information is mainly hosted in Québec (Canada). However, certain suppliers may host data in the United States, where it is subject to local laws (e.g., disclosure obligations to authorities). Nutrisanté Laboratories ensures that contractual and security measures are in place to deal with these situations.
Nutrisanté Laboratories may transmit information collected about you to countries other than Canada where it was originally collected, for data storage and processing purposes, as well as to operate its services. These countries may not have the same data protection regulations as Canada. However, when such transfers occur, Nutrisanté Laboratories protects your personal information and takes steps, where necessary, to ensure that international transfers are carried out in accordance with applicable regulations.
8. Data security
Nutrisanté Laboratories is concerned about protecting the personal information it processes and takes appropriate security measures to that end. Despite our efforts, we cannot promise or guarantee that your information shared with Nutrisanté Laboratories will be completely secure or that your information on the platform will not be exposed, revealed, altered or deleted as a result of a breach of any of our physical, administrative or technical measures.
As mentioned above with respect to restricting access to personal data, Nutrisanté Laboratories has adopted appropriate measures to limit the right of use of its information systems so that only employees who need to know are authorized to access them.
9. Anti-spam
Nutrisanté Laboratories respects the Canadian Anti-Spam Act in our commercial electronic communications. When we collect your email address, telephone number, cell phone number or addresses, the use of this information complies with the Canadian Anti-Spam Legislation. Therefore, you will only receive electronic messages from us if you have given us your express consent or if we are authorized to do so by law. You may withdraw your consent at any time to stop receiving commercial email messages. Please note, however, that Canada's Anti-Spam Legislation provides for exceptions allowing such messages to be sent.
10. Minors
The services offered by Nutrisanté Laboratories and the use of its website are not intended for persons under the age of 14. Nutrisanté Laboratories does not knowingly collect personal information from persons under the age of 14. If you are a parent or guardian and the person under the age of 14 for whom you are responsible has provided us with personal information, please contact us immediately so that we may take steps to delete such information. When we become aware that a person under the age of 14 has provided us with personal information without the consent of the person with parental authority, we will delete the personal information collected.
When the laws of your country of origin require the consent of the person holding parental authority for the processing of your personal information, Nutrisanté Laboratories may require it prior to any collection of personal information.
